Crime victims are forgotten in criminal proceedings. Criminal justice systems tend to treat crime victims quite poorly, but, when they deal with child victims, their frequent failure to respect the child’s rights finds no excuse. Law enforcement and criminal justice interventions made in the name of protecting children against violent crime often fail to consider what is truly in the best interests of the child and end up further victimizing the child victims. Vietnam has instituted justice reforms that recognize the (...) need for special measures to protect the rights of child victims and witnesses of crime. This article reviews the progress achieved in implementing these reforms and points at several areas where implementation has been slow or further reforms are needed. Based on a comparative legal analysis, the article exemplifies how legal semiotics can contribute to an understanding of the complexity of policy transfer in the area of justice and human rights. Os pensamentos de Phan Boi Chau são uma valiosa herança histórica e uma fonte prática de inspiração, contribuindo para a construção de um Vietnã civilizado, moderno e único no futuro. Ao construir um país forte e desenvolvido no Vietnã, estudar os pensamentos de Phan Boi Chau fornece uma perspectiva abrangente sobre questões econômicas, políticas e sociais, encontrando assim soluções apropriadas para enfrentar os desafios modernos no contexto da globalização e garantindo um desenvolvimento sustentável e harmonioso. Este estudo, portanto, examina o (...) pensamento patriótico e as atividades revolucionárias de Phan Boi Chau (1867–1940), um proeminente pensador e ativista vietnamita no início do século XX. Empregando métodos materialistas dialéticos, analítico-sintéticos e históricos, a pesquisa investiga o papel de Phan Boi Chau na inspiração da luta vietnamita contra o colonialismo francês e sua evolução ideológica do confucionismo para princípios democráticos e socialistas. As descobertas revelam a liderança de Phan Boi Chau em movimentos como Duy Tan Hoi, Dong Du e Vietnam Quang Phuc Hoi, destacando sua ênfase estratégica em educação, esclarecimento e renascimento nacional. Apesar das limitações de seu caminho para a salvação nacional, as ideias e esforços de Phan Boi Chau criaram a base para movimentos revolucionários posteriores. O legado de Phan Boi Chau inspira patriotismo, resiliência e desenvolvimento intelectual na trajetória de desenvolvimento moderna do Vietnã. (shrink)

Discovering high-utility itemsets (HUIs) consists of finding sets of items that yield a high profit in customer transaction databases. An important limitation of traditional high-utility itemset mining (HUIM) is that only the utility measure is used for assessing the interestingness of patterns. This leads to finding several itemsets that have a high profit but contain items that are weakly correlated. To address this issue, this paper proposes to integrate the concept of correlation in HUIM to find profitable itemsets that are (...) highly correlated, using the all-confidence and bond measures. An efficient algorithm named FCHM (fast correlated high-utility itemset miner) is proposed to efficiently discover correlated high-utility itemsets (CHIs). Two versions of the algorithm are proposed: FCHM|$_{all\text{-}confidence}$| and FCHM|$_{bond}$|⁠, which are based on the all-confidence and bond measures, respectively. An experimental evaluation was done using four real-life benchmark datasets from the HUIM literature: mushroom, retail, kosarak and foodmart. Results show that FCHM is efficient and can prune a huge amount of weakly CHIs. (shrink)

The relationship between greenwashing and visitors' green behavior remains an under-researched topic in the tourism and hospitality literature, despite evidence of the harmful effect of greenwashing on the reputation and competitive advantage of organizations. This study extends attribution theory into the green context to develop a research framework for investigating the interrelationship between greenwashing, green trust, and green word-of-mouth (WOM), especially the roles of green trust and connectedness to nature. We conducted a survey of 289 visitors staying in four- and (...) five-star hotels in Vietnam. The findings indicated that hotels should avoid greenwashing due to its negative impact on visitors' green trust and green WOM. Moreover, the study found that greenwashing had an indirect and negative influence on green WOM based on visitors' green trust. Importantly, the research revealed the value of connectedness in moderating green attitudes and behaviors among visitors. (shrink)

Nowadays, the power systems are getting more and more complicated because of the delays introduced by the communication networks. The existence of the delays usually leads to the degradation and/or instability of power system performance. On account of this point, the traditional load frequency control approach for power system sketches a destabilizing impact and an unacceptable system performance. Therefore, this paper proposes a new LFC based on adaptive integral second-order sliding mode control approach for the large-scale power system with communication (...) delays. First, a new linear matrix inequality is derived to ensure the stability of whole power systems using Lyapunov stability theory. Second, an AISOSMC law is designed to ensure the finite time reachability of the system states. To the best of our knowledge, this is the first time the AISOSMC is designed for LFC of the LSPSwCD. In addition, the report of testing results presents that the suggested LFC based on AISOSMC can not only decrease effectively the frequency variation but also make successfully less in mount of power oscillation/fluctuation in tie-line exchange. This paper explores the relationship between revolution and corruption in Jean Genet’s accounts of the Palestinian movement in his final work, Prisoner of Love. For Genet, corruption does not simply expose the actions of a revolutionary subject as an empty impersonation, performed for the actual ends of acquiring personal power and fortune. Rather, it exposes the ‘pretension’ inherent in the revolution it undermines as well as in the accumulation of value. For Genet, the misappropriation of money by the Palestinian leadership (...) makes manifest the imaginary character of both devotion to a revolutionary cause and greed for the commodity-fetish. Corruption, in other words, betrays revolution as well as the ‘imaginary wealth and power’ which the ‘game of revolution’ attempts to destroy. (shrink)

Rapid urbanization in Vietnam significantly impacts the environment and human well-being. Public parks are crucial for enhancing social and environmental sustainability in urban areas, yet their establishment and expansion require substantial funding. This study investigates the factors influencing Vietnamese urban residents’ willingness to donate to planting projects in public parks, utilizing the Bayesian Mindsponge Framework (BMF), which combines Mindsponge Theory’s informational entropy-based notion of value with Bayesian analysis. Analyzing data from 535 residents in major Vietnamese cities, we found that while (...) men visit public parks more frequently, they are less willing to donate to planting projects. Older residents visit parks more often and are more willing to donate, while higher-income individuals show greater willingness to donate. Most motivations—such as relaxation, physical activities, nature enjoyment, socializing, and family time—are positively linked to park visit frequency and indirectly to donation willingness. However, only relaxation and enjoyment of nature are directly associated with willingness to donate. Interestingly, higher education levels and visiting parks for children’s educational activities are associated with lower donation willingness. These findings hint at the possible existence of the free-riding problem, gender inequality, ineffective environmental education, and lack of awareness of public parks’ natural value, as well as opportunities to cultivate an eco-surplus culture through nature interactions in public parks. Le visage d'Edith Stein a disparu dans le martyre qu'elle subit à Auschwitz le 9 août 1942. Depuis lors, ses différents biographes ont tenté de recomposer les éléments de sa vie et de sa personnalité à partir d'une facette de sa personnalité. Edith Stein philosophe, Edith Stein carmélite, Edith Stein féministe: les approches se succèdent et esquissent les différents traits d'un visage dont l'unité demeure cachée dans le secret d'une destinée. Dans ce livre, Philibert Secretan propose une approche synchronique d'Edith (...) Stein. "Le portrait que je propose ici s'organise autour de trois données de fait : la conversion du judaïsme au christianisme ; le passage de la phénoménologie à la sagesse philosophique ; l'entrée au Carmel. Autant de faits qu'il s'agit de traiter non plus en diachronie, comme autant d'étapes d'une existence étalée dans le temps, mais en synchronie, comme autant de strates d'une personnalité dans laquelle continuent à résonner des échos de ces moments constitutifs de son être singulier". Tres síntomas asociados al neoconstitucionalismo llaman poderosamente la atención: 1), la variedad y la cantidad de literatura dedicada al tema en los últimos veinte años, particularmente en España, Italia y América Latina; 2), el alcance y la pasión de las acusaciones y las defensas de las que ha sido objeto y de las que, con él, han sido objeto particularmente los principios y la ponderación; y 3), la fuerte presencia que se le suele reconocer en casi todos los actuales debates (...) teóricos y filosóficos del mundo jurídico latino. Esos síntomas sugieren que las controversias y los intereses que suscita tocan un aspecto jurídico neurálgico: las relaciones entre el Derecho y la moral. El neoconstitucionalismo constituye, en ese sentido, una corriente desafiante para el pensamiento jurídico contemporáneo, más aún en el contexto del inquietante y sorpresivo mundo de hoy. El desafío debe aceptarse y, para hacerlo, es menester adentrarse en la comprensión de todo lo que implica y todo lo que moviliza el neoconstitucionalismo. (shrink)

A partir de la figura del Nuevo Testamento en el Evangelio de Juan y las indicaciones apocalípticas en la Segunda Epístola de Pablo a los Tesalonicenses, estudia al Anticristo en el libro de 1888 como una inversión del anatema de Lutero contra Roma y el papado en 1520, ahora vuelto contra el cristianismo mismo. Una lucha tan despiadada tiene el significado de Reino y redención como apuesta única.

El pensamiento de Derrida sobre el amor no suele ser estudiado porque, al parecer, el mismo autor no ha sido tan claro al respecto. Este artículo pretende aportar a este vacío usando como documento de estudio el libro Éperons del autor, que pretende ser una ponencia sobre Nietzsche. A partir de una interpretación de los pasajes en los que Derrida se refiere al amor, encontramos casi siempre se trata de una cita de Nietzsche. Esto parece caracterizar un acto de ventriloquia (...) que subyace a la estrategia del autor. El problema surge cuando nos percatamos de que Derrida no da cuenta de la intromisión del amor en las citas que usa. Derrida prefiere evadir el problema del amor porque está en el núcleo de su propuesta de deconstrucción. (shrink)

Sosyal bilimler alanında, ortak zaman diliminde yaşamanın getirisi olarak benzer özelliklere sahip bireylerin oluşturduğu gruplar “kuşak” kavramı ile tanımlanmaktadır. Günümüzde, kuşaklar ortak bir kabul olarak; Gelenekselciler, Bebek Patlaması, X, Y ve Z Kuşağı olarak literatürde yer almaktadır. Ortak zaman diliminde yaşayan insanların algıları, beklentileri, hayata bakış açıları, alışkanlıkları ve gündelik yaşam pratikleri kendilerinden önceki ve sonraki zamanlarda yaşayanlara göre farklılık göstermektedir. Gündelik yaşamın pratiklerinde yaşanılan değişimin en yoğun hissedildiği alan toplumlarda genel olarak aile kurumu üzerindedir. Günümüzde, Y Kuşağı temsilcilerinin çoğu (...) aileleriyle bir arada yaşayan ve kendinden farklı bir kuşağın temsilcisi olan anne babalarıyla zor iletişim kuran bireyler olarak toplumda yer almaktadır. Toplumu oluşturan en küçük birim olarak tanımlanan aile, eğitim, sağlık ve güvenlik gibi bazı işlevlerini başka kurumlara aktarmış olsa da ulusların ve kültürlerin gelişimi için temel birim olmaya devam etmektedir. Toplumun temel yapısını oluşturan aile kurumu, bireylerin ve toplumun gösterdiği değişime paralel bir şekilde değişmektedir. Ailenin yapısında görülen değişimlere rağmen aile, özünde toplumun en küçük birimi olarak kalmaya ve hem bireyler için hem de toplum için işlevini sürdürmeye devam etmektedir. Bu çalışmada, önceki araştırmalar ve Y kuşağının temel özellikleri dikkate alınarak bu kuşak temsilcileri için ailenin değişen anlam ve önemine ve toplumsal yaşamda nasıl bir belirleyiciliği olduğuna değinilmektedir. Toma en cuenta alrededor de 100 especies: bivalvos, incluso mejillones de agua dulce; gasterópodas; cefalópodas; crustáceas, incluso cangrejos de río; erizos y anémonas de mar. El artículo propone una historia tan detallada como sea posible de cada especie o grupo de especies cercanas; evoca las evoluciones de sus representaciones (...) sociales, de sus valorizaciones comerciales, de sus preparaciones culinarias, etc. Con su importante litoral sobre el Golfo de Vizcaya y sus ciudades ubicadas tierra adentro, el sudoeste de Francia constituye un área de estudio interesante para pensar la complejidad de los hábitos de consumo de mariscos durante el periodo anterior al desarrollo de los transportes rápidos y a la invención del frio artificial.: This text is a study on the consumption of marine and freshwater invertebrates in Southwest France from the early 16thcentury to the present day. Around 100 species are taken into account: bivalves including river mussels; gastropods; cephalopods; crustaceans including crayfishes; urchins and sea anemones. The article proposes a history as detailed as possible of each species or group of closely related species, including the evolution of their social representations, commercial valuations, culinary preparations, etc. With its important coastline on the Gulf of Gascony and its inland cities, Southwest France forms an interesting study area to think about the complexity of seafood consumption patterns in the era before the development of rapid transports and the invention of artificial refrigeration. Fıkıh literatüründe sünnet önemli bir yere sahiptir. Çünkü fıkhın temeli Hz. Peygamber tarafından atılmış ve fıkhın gayesini en iyi bilen ve uygulayan kendisi olmuştur. Bu sebeple şer’î amelî konularda hüküm istinbatı için müctehid imamlar, Kur’an’dan sonra sünnete başvurmuşlardır. Bununla birlikte müctehid imamlar, Hz. Peygamber’den gelen rivayetlerin bazılarını kabul ve onlarla amel etmede görüş ayrılıkları yaşamışlardır. Görüş ayrılıklarının temelinde ise sünnetin ekseriyetini teşkil eden haber-i vâhid vardır. Çünkü haber-i vâhid yapısal açıdan yalan, yanlışlık ve vehm ihtimali bulundurması yanında doğruluğu zan ile (...) sabit olması sebebiyle özellikle Hanefî usûlcülerine göre bilgi ifade etmez. Bu yönüyle haberi vâhid, mütevâtir haber kadar kuvvetli ve bağlayıcı olmayıp zannî bir bilgi ifade eder. Bu doğrultuda haber-i vâhid, “bilgi gerektirmez, zan gerektirir” şeklinde ifade edilmiştir. Bu ifade bağlamında şöyle bir soru ortaya çıkmaktadır: Haber-i vâhid, bilgi ifade etmediği halde, onunla amel edilmesi mümkün müdür? Bu sorudan hareketle zan ifade eden haber-i vâhidin hücceti ve onunla amel edilmesinin mümkün olup olmadığını, mezheplerin haber-i vâhide yaklaşımlarının nasıl olduğunu ve bu durumun cenaze bahsine ilişkin hükümlere nasıl yansıdığını ortaya koymak amacıyla bu çalışma ele alınmıştır. Dolayısıyla bu çalışmanın konusu, haber-i vâhidin hücceti için mezheplerin ileri sürdüğü farklı şartlar ve bu şartların hükümlere -cenaze namazı özelinde- etkisi ile sınırlıdır. Yöntem olarak öncelikle kavramsal çerçevede haber-i vâhidi tanımlamak, bilgi değerini ortaya koymak ve mezheplerin onunla hücceti noktasında benimsedikleri şartları tespit etmek amacıyla ilgili mezheplerin usûl eserleri incelenmiştir. Daha sonra mezheplerin benimsediği bu usûlî yöntem, cenaze bahsindeki yerini belirlemek üzere ilgili mezheplerin fürû kitapları taranmıştır. Bu metottan hareketle mezheplerin usûlde benimsediği ilkenin fürû meselelerine nasıl yansıdığı, haber-î vâhidin zannî bilgi ifade etmesine rağmen onunla amel etmenin gerekçesi ve cenazeye ilişkin bazı hükümlerde mezheplerin farklı hüküm benimsemelerinin nedeni ortaya konulacaktır. Muhtelif okumalar, kârîlerin aynı imâle olgusunu ferdî tecrübeleriyle seslendirmelerinden kaynaklanmaktadır. O halde imâlenin kişisel deneyimlerden arındırılarak, ilk dönemlerden itibaren kitâbî olarak nasıl neşv-ü nemâ bulduğu ve nihaî olarak nasıl bir tanım ve uygulamaya eriştiğiyle ilgili bir tespite gereksinim duyulmaktadır. Bu sayede hangi kârî ya da kârîlerin, imâleyle ilgili telaffuz biçiminin sahih okuyuşa en yakın olduğu sonucuna erişilebilecektir. Makalemizde sahih okuyuşu tespit (...) etmek amacıyla, imâle ve feth çeşitlerinin ilk dönem eserlerinden bu yana nasıl açıklandığını, kategorilerinin karşılaştırmalı olarak nasıl değerlendirildiğini, bazı kârîlerin okuyuşlarından örnekler de sunarak incelemeye çalışacağız. XVI, sin una aparente fuente de continuidad, que cualquier persona con un poco de mentalidad científica no puede dejar de preguntarse: ¿de dónde la ha sacado? ¿De dónde ha extraído esa comprensión tan profunda del mundo, y ese pensamiento tan hermoso? Cualquiera puede pensar que, pensamiento político o jurídico semejante había de (...) derivarse de algún manuscrito empolvado y escondido en algún lugar, como un tesoro, cuya influencia hubiera ejercido, de manera latente, y a este investigador le hubiera tocado descubrir. Pero veremos que no: que el verdadero tesoro escondido es la simple idea de amistad, entendida en su sentido más pleno. (shrink)

Retomando el tan explorado debate entre elitismo y populismo penal, este libro adopta una perspectiva republicana para argumentar a favor de un mayor grado de participación popular en la determinación de las penas. En el plano de la teoría no-ideal, se argumenta que fenómenos como las dinámicas de indignación y los linchamientos, contrariamente a lo que se sugiere, cuentan a favor de la democratización de los sistemas penales. En este sentido, el libro disputa el enfoque de quienes sostienen que las (...) preferencias punitivas arbitrarias de los ciudadanos deberían favorecer mecanismos que aíslen la política criminal de la influencia popular. Por el contrario, se argumenta que tanto el elitismo como el populismo penal operan como fuentes de diferentes tipos de dominación y, por lo tanto, deben evitarse en un estado republicano. Adicionalmente, el libro se propone responder a la necesidad de revisar los presupuestos teóricos del pensamiento crítico sobre los sistemas penales señalada por Carlos Santiago en su debate con Eugenio Raúl Zaffaroni. En consecuencia, la pregunta sobre cuál debe ser el grado de participación popular en los sistemas penales es abordada en el marco de la teoría política republicana. Selon Jean Ricardou, le concept "matérialiste" de production est censé rendre caduques les principales catégories de l'esthétique de la production: création, expression, inspiration, imitation. Par l'analyse d'une fiction témoin, cet article montre que la genèse de ce texte peut s'expliquer tans par la théorie de la production de Ricardou que par une approche plus classique. Refusant le dogmatisme et la dépréciation axiologique, il plaide pour une approche plurielle des phénomènes esthétiques.

Pocos términos existen tan mudables en la cultura occidental como el de retórica. Se le define como arte de la persuasión, como teoría de la argumentación o incluso como ciencia literaria. Todas estas perspectivas tienen un denominador común: entienden los tropos y figuras retóricas como instrumentos comunicativos y literarios. Sin obviar estos desarrollos de la retórica, los autores de este trabajo tratan de discernir los aspectos cognitivos rastreables en la retórica clásica y, al tiempo, ofrecer un acercamiento a lo que (...) sería una retórica cognitiva, basada en el presupuesto de que tropos y figuras son redes conceptuales que estructuran el pensamiento humano.….
